Section Schedule of Uttarakhand Jan Vishwas (Amendment of Provisions) Act, 2026 — THE SCHEDULE

1. | 2005 | 06 | The Uttarakhand River Valley (Development and Management) Act, 2005 | In section 23,- (i) sub-section (2) shall be substituted as follows, namely- "(2) Any person who obstructs the entry of a person Authorised under section 16 to entry into or upon any land or building or molests such person after such entry shall be punishable with fine of five thousand rupees". (ii) clause (d) of sub-section (3) shall be substituted as follows, namely- "(d) For the purpose of obtaining any permission or NOC under section 21 of the Act makes a statement which is false in any material particular or in any way pollutes the River Valley or otherwise contravens the provisions of this Act shall be punishable with fine of minimum two thousand and maximum of ten thousand rupees for first offence and minimum of ten thousand rupees and a maximum of twenty thousand rupees for subsequent offences:" (iii) after clause (d) of sub-section (3) following proviso shall be inserted, namely- "Provided that in cases where there is a violation of clause (a) and (b) of sub-section (3) of section 23, the offender shall be punished with a fine of fifty thousand rupees or imprisonment of up to two months or both."

2. | 2013 | 07 | The Uttarakhand Flood Plain Zoning Act, 2012 | In section 13,- (i) clause (a) and (b) shall be substituted as follows, namely.- (a) with fine which may extend to five thousand rupees, and (b) with further fine which may extend to one thousand for each day during which the offence continues after conviction under clause (a); and (ii) following new clause (c) shall be inserted, as follows, namely:- "(c) In cases where a subsequent offence of the same nature has been committed a fine which may extend to twenty thousand rupees or simple imprisonment for a term which may extend to two months or both,."

3. | 2013 | 17 | The Uttarakhand Plastic And Other Non-Biodegradable Garbage (Regulation Of Use And Disposal) Act, 2013 | In section 10,- for the words " three months", the words "one month " shall be substituted.

4. | 2016 | 18 | The Uttarakhand Reforms, Regularization, Rehabilitation, Resettlement and Prevention of Encroachment of the Slums located in the Urban Local Bodies of the State Act, 2016 | In section 5 for the words "six months", the words "three months" shall be substituted.

5. | 2019 | 07 | The Uttarakhand Public Services (Reservation for Economically Weaker Sections)Act, 2019 | In section 5,- (i) in sub-section (1), for the words, figures and sign "be punishable with imprisonment which may extend to 3 months or with fine which may extend to 20000 or both;" the words, figures and sign "be punishable with fine which may extend to Rs. 40,000/" shall be substituted; (ii) sub-section (2) shall be omitted; (iii) sub-section (3) shall be omitted.
