The Rajasthan Municipalities (Amendment) Act, 2023, is a targeted legislative update to the Rajasthan Municipalities Act, 2009. Its primary purpose is to close a loophole regarding the removal of municipal members who were ineligible to hold office at the time of their election. Previously, if a candidate was disqualified but no election petition was filed within the statutory timeframe, they could potentially remain in office. This amendment empowers the State Government to remove such members even after the election petition period has expired, provided it is discovered they were disqualified under Sections 14, 21, or 24 of the parent Act.
