Section 63 of The JAMMU AND KASHMIR MUNICIPAL ACT, 2000
- (1)Whenever the Government is satisfied that the municipality has neglected to perform its duties in respect of maintenance or construction of water works, sewerage works or roads and that it is in public interest to take over the management of such water works, sewerage works or roads for a period not exceeding ten years, it may, after giving the municipality a reasonable opportunity of showing cause against the proposed action, make an order to take over the management of water works, sewerage works or roads, as the case may be.
- (2)The management of water works, sewerage works or roads, as the case may be, shall revert to the municipality after the expiry of the period for which it was taken over by the Government or earlier than that if deemed expedient by the Government.
- (3)It shall be the liability of the municipality to pay the expenses, if any, which may be incurred by the Government as also the liability in respect of the salary and allowances of the persons employed, by the municipality before taking over the management, for and in connection with the maintenance, construction, management and control of the water works, sewerage works or roads.
- (4)Whenever the management of any water works, sewerage works or roads of any municipality is taken over by the Government, the powers, duties and functions of the municipality under this Act in respect of such water works, sewerage works or roads shall be exercised and performed by the Government.
