Section 11 of Uttarakhand Prevention of Public Gambling Act, 2026 — Presumption with regard to seizure of instrument of gambling

(1) Whenever any instrument of gambling is found in any place, it shall be presumed that such instrument being used for gambling, and shall be taken as a evidence of the fact that such place, including house, enclosure, room, vehicle, ship, was and is being used for gambling by an organised gambling syndicate in contravention to this Act, and that the person owing, or operating, or having charge thereof is a member of such organised gambling syndicate, unless the contrary is proved. (2) Whoever is a member of a gambling syndicate under sub-section (1) then he shall be liable to rigorous imprisonment for a term which shall not be less than three years but which may extend to five years and with fine which shall not be less than two lakh rupees but which may extend to ten lakh rupees.
