Section 38 of The School of Planning and Architecture Act, 2014 in hindi
No act of the Council, or any School or Board or Senate or any other body set up under this Act or the Statutes, shall be invalid merely by reason of—
- (a)any vacancy or defect in the constitution thereof; or
- (b)any defect in the election, nomination or appointment of a person acting as a Member thereof; or
- (c)any irregularity in its procedure not affecting the merits of the case.
Summary
- Decisions and proceedings made by the Council, a School, the Board, the Senate, or any other body under the Act are legally safe from being cancelled just because a seat was empty.
- If a mistake is discovered later in how a member was elected, nominated, or appointed, it does not ruin the legal standing of the work they did.
- Minor errors in the constitution of a committee or body will not invalidate its actions.
- Procedural mistakes can only invalidate an action if the mistake actually affects the genuine merits or fairness of the case at hand.
