Section 174 of The JAMMU AND KASHMIR CO-OPERATIVE SOCIETIES ACT, 1989
- (1)In exercising the functions conferred on it by or under this Act, the Government, the Tribunal, the Registrar, the Arbitrator or any other person deciding any dispute and the liquidator of a Cooperative society shall have all the powers of a Civil Court while trying a suit under 1[the Code of Civil Procedure, 1908 (5 of 1908)], in respect of the following matters, namely :—
- (a)summoning and enforcing the attendance of any person and examining him on oath ;
- (b)requiring the discovery and production of any document ;
- (c)proof of facts by affidavits ; and
- (d)issuing commission for examining of witness.
- (2)In the case of any affidavit any Magistrate of the First Class or any officer appointed by the Government, the Tribunal, Registrar, the arbitrator or any other person deciding a dispute or the liquidator, as the case may be, in this behalf may administer the oath to the deponent.
